- The Sale Agreement covers new Products.
- The seller is obliged to provide the customer with a product free of defects.
- In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions regarding warranty in the Civil Code.
- If the Customer is an Entrepreneur, the parties exclude liability under the warranty.
- Complaints should be submitted by e-mail to office@decorative-art.co.uk
- It is recommended that the complaint include, inter alia, brief description of the defect, circumstances (including the date) of its occurrence, data of the Customer submitting the complaint, and the Customer’s request in relation to the defect of the goods. If the damage arose as a result of incorrect delivery of the product and therefore its damage, a damage report must be drawn up with the courier during delivery of the product.
- It is recommended to send a photo of the defect or damaged package in the event of damage to the goods during transport.
- The Seller shall respond to the complaint request immediately, no later than within 14 days, and if he does not do so within this period, it is considered that the Client’s request was considered justified.
- Goods returned under the complaint procedure should be sent to the address provided by the Seller.
- After accepting the complaint, the Seller will exchange the item for one free of defects or return the full amount to the Buyer for damaged goods.
- A physical defect consisting in the incompatibility of the sold item with the contract expressed by the lack of properties that the sculpture should have due to the purpose in the contract marked either resulting from circumstances or purpose, or the lack of properties that the seller has assured the buyer is not considered:
- minor differences in the details of handmade items
- differences in the natural color and “use” of marble from which the foundations of our sculptures are made
- differences in the color of elements made of other precious and natural stones
- natural patina on bronze and cast iron items
- differences in the coloring and decoration of glass in objects in the style of Murano Glass
- differences in the coloring of the glass and cut decorations in the Cameo Glass vase
- differences in the color and arrangement of Tiffany style lamp shades
- differences in the layout and colors of hand-painted and glazed porcelain
- natural changes arising over time on objects made of natural materials
- natural changes arising over time on objects exposed to long-term exposure to atmospheric conditions
Right to Cancel
Cancellation:
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right to cancel, you must inform us (Wojciech Socharczenko Pixart, Zygmunta Miłkowskiego 3/602 (Colloseum Office Bulding), 30-349 Kraków, Poland, (e-mail: office@decorative-art.co.uk, mobile: +48 660 697 946) of your decision to cancel this contract by a clear statement (e.g. e-mail). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
! The right to withdraw from a distance contract does not apply to:
Agreements in which the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or serving to satisfy his individual needs.
